This week, California state legislators heard cannabis bills pertaining to tax revenue, licensing and applications, as well as commercial regulations and enforcement.
AB 2555, a bill to amend sections of the Business and Professions code, would redefine key cannabis terminology, requiring an identifier to be issued only for “mature cannabis plants,” as defined by the amendment. AB 2555 was scheduled for a hearing on Monday June 11, 2018, but was rescheduled by the Senate Business, Professions and Economic Development committee for June 25, 2016.
AB 1741 would allow some cannabis business to continue to pay their tax liability with cash if their monthly estimated tax liability fell below $20,000 per month. Cannabis businesses with a monthly tax liability over $20,000 would be required to pay via electronic transfer. AB 1741 passed the Senate Governance and Finance Committee with a 6-1 vote Wednesday, June 13, 2018,, and has been referred to the Senate Appropriations committee, where it awaits a hearing date.
AB 2721 would allow individuals 21 and older access to testing facilities to have non-medical cannabis samples analyzed. The samples would have to be from cannabis plants grown for personal use only. It passed the Senate Business, Professions and Economic Development Committee with a 7-0 vote Monday, June 11, 2018. The bill has been referred to the Senate Appropriations committee.
AB 1744 would use cannabis tax revenue to provide grants for The After-School Education and Safety Program. Qualifying programs would be required to include youth development activities that promote healthful lifestyle choices and behaviors in order to prevent or reduce substance abuse.. The bill passed the Senate Education Committee with a 7-0 vote Wednesday, June 13, 2018. The committee referred AB 1744 to the Senate Health Committee, where a hearing was scheduled for June 20, 2018.
AB 1996 would use funds from the California Tax Fund to establish the California Cannabis Research Program. The bill would authorize the program to cultivate cannabis in order to develop studies and conduct research.It passed the Senate Business, Professions and Economic Development Committee with a 8-0 vote. AB 1996 has been referred to the Senate Appropriations committee, where it awaits a hearing date.
AB 2799 would require cannabis business applicants to employ, within one year of receiving a license or renewal, one supervisor and one employee who have completed the Division of Occupational Safety and Health (Cal-OSHA) 30-hour general industry course. It passed the Senate Business, Professions and Economic Development Committee by a 7-1 vote Monday, June 11, 2018, and has been referred to the Senate Appropriations committee, where it awaits a hearing date.
AB 3067 would prohibit websites, online services, online applications, mobile applications and advertising services from promoting cannabis or cannabis-related products or services to minors. It passed the Senate Business, Professions and Economic Development Committee by a 8-0 vote and was referred to the Senate Judiciary committee, where it awaits a hearing date.
AB 873 would allow the California Department of Food and Agriculture to designate investigators, investigator supervisors, or investigator managers, to enforce regulations, and investigate commercial cannabis activity. It passed the Senate Public Safety Committee by a 7-0 vote Tuesday, June 12, 2018. The bill has been referred to the Senate Appropriations committee, where it awaits a hearing date.
SB 1127 proposes confidentiality for student records collected by school personnel that show students are using medicinal cannabis. The records shall not be open to the public for any reason other than a state or federal court order. was scheduled for a hearing Wednesday, June 13, 2018, before. SB 1127 the Assembly Education Committee with a 4-1 vote and has been referred to the Senate Judiciary committee, where it awaits a hearing date.
