Weekly Legislative Schedule: The Business of California, Colorado Lawmakers is Business … of Marijuana

Important cannabis legislation will receive hearings in California and Colorado during the week of April 30, 2018. Among the many legislative issues being considered by California’s lawmakers this week are: business deductions for the state’s marijuana industry and the California Cannabis Research Program. In Colorado, elected officials will attempt to define industrial hemp as they try to establish parameters for the state’s marijuana testing facilities.

As we prepare to say goodbye to April and hello to May, progressive cannabis legislation continues to cultivate strong roots in the body of American politics.

California

AB 1863 would allow for state compliant California cannabis cultivation businesses to deduct business expenses in the calculation of their personal income taxes, effective immediately. The proposed legislation was scheduled to receive a hearing on Monday, April 30, 2018, at 2:30 p.m. before the Assembly Revenue and Taxation Committee In State Capitol Room 126 in Sacramento.

AJR 28 is a bill to encourage Congress and President Donald Trump to pass legislation to allow America’s financial institutions to provide services to the cannabis industry. The proposed banking bill was scheduled to receive a hearing on Monday, April 30, 2018, at 3 p.m. in Room 444 of the Capitol in Sacramento.

AB 1793 addresses the resentencing of past cannabis convictions. The legislation proposes for the state’s Justice Department be required to review the records of Californians convicted of cannabis-related charges and reduce or dismiss penalties unless challenged by a prosecutor. The proposed bill was scheduled to receive a hearing on Wednesday, May 2, 2018, at 9 a.m. before the Assembly Appropriations Committee in State Capitol Room 4202.

AB 1996 seeks to establish the California Cannabis Research Program. The program would develop and allow for studies intended to ascertain the general safety and efficacy of medical cannabis and, if found valuable, would develop medical guidelines for the appropriate administration and use of medical marijuana. Assembly Bill 1996 was scheduled to be heard on Wednesday, May 2, 2018, at 9 a.m. before the Assembly Appropriations Committee in Room 4202 of the Capitol in Sacramento.

AB 2721 would authorize a testing laboratory to receive and test samples of cannabis or cannabis products grown by an adult for personal use. AB 2712 was scheduled to be heard on Wednesday, May 2, 2018, at 9 a.m. before the Assembly Appropriations Committee in Room 4202 of the Capitol in Sacramento.

AB 2799 would create a state-mandated Cal-OSHA training program for California’s legal cannabis industry. The bill would require an applicant for a state license under The Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) provide proof the applicant will hire a Cal-OSHA certified trainer. The legislation was scheduled to be heard on Wednesday, May 2, 2018, at 9 a.m. before the Assembly Appropriations Committee in Room 4202 of the Capitol in Sacramento.

Colorado

HB 1295 would modify the Colorado Food and Drug Act to establish that food, cosmetics, drugs, and devices — as those are defined in the act — are not adulterated or misbranded if they contain industrial hemp. The bill also defines “industrial hemp” and “industrial hemp food product,” and sets forth the Department of Public Health and Environment’s powers to regulate the wholesale food selling, manufacturing, processing, or storage of an industrial hemp food product. The bill was scheduled for a hearing Monday, April 30, 2018, at 8:30 a.m. before the House Conference Committee in Senate Conference Room 354 in Denver.

HB 1422 would require medical and retail cannabis testing facilities to be accredited pursuant to the International Organization for Standardization (ISO)/International Electrotechnical Commission standard by January 1, 2019. The state licensing authority can adopt rules providing for an extension to comply with the standard. The bill states that medical and retail cannabis testing is a matter of statewide concern. The bill was scheduled to receive a hearing Monday, April 30, 2018, at 8:30 a.m. before the House Conference Committee in Legislative Building A in Denver.

HB 1389 wouldcreate a centralized distribution permit to an optional premises cultivation facility or retail cannabis cultivation facility authorizing warehousingfor Concentrate or marijuana products. The bill was scheduled for a hearing Tuesday, May 1, at 1:30 p.m. before the House Finance Committee in Room 112 in Denver.
