California
AB 1863 would allow for state compliant California cannabis cultivation businesses to deduct business expenses in the calculation of their personal income taxes, effective immediately. AJR 28 is a bill to encourage Congress and President Donald Trump to pass legislation to allow America’s financial institutions to provide services to the cannabis industry. The proposed banking bill was scheduled to receive a hearing on Monday, April 30, 2018, at 3 p.m. in Room 444 of the Capitol in Sacramento.
AB 1793 addresses the resentencing of past cannabis convictions. The legislation proposes for the state’s Justice Department be required to review the records of Californians convicted of cannabis-related charges and reduce or dismiss penalties unless challenged by a prosecutor. AB 1996 seeks to establish the California Cannabis Research Program. The program would develop and allow for studies intended to ascertain the general safety and efficacy of medical cannabis and, if found valuable, would develop medical guidelines for the appropriate administration and use of medical marijuana. AB 2721 would authorize a testing laboratory to receive and test samples of cannabis or cannabis products grown by an adult for personal use. AB 2799 would create a state-mandated Cal-OSHA training program for California’s legal cannabis industry. The bill would require an applicant for a state license under The Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) provide proof the applicant will hire a Cal-OSHA certified trainer. The legislation was scheduled to be heard on Wednesday, May 2, 2018, at 9 a.m. before the Assembly Appropriations Committee in Room 4202 of the Capitol in Sacramento.
Colorado
HB 1295 would modify the Colorado Food and Drug Act to establish that food, cosmetics, drugs, and devices — as those are defined in the act — are not adulterated or misbranded if they contain industrial hemp. The bill also defines “industrial hemp” and “industrial hemp food product,” and sets forth the Department of Public Health and Environment’s powers to regulate the wholesale food selling, manufacturing, processing, or storage of an industrial hemp food product. HB 1422 would require medical and retail cannabis testing facilities to be accredited pursuant to the International Organization for Standardization (ISO)/International Electrotechnical Commission standard by January 1, 2019.
