California Releases Regulations for Marijuana Industry

The proposed rules and regulations that will govern the California cannabis industry were released Friday, July 13, 2018, marking the first step toward establishing permanent regulations for the burgeoning industry.

The three state agencies that oversee the California cannabis market, the world’s largest, include the Bureau of Cannabis Control (BCC), the Department of Food and Agriculture and the Department of Public Health. Each agency will be hosting public hearings throughout California and accepting written comments during the public comment period, which closes Aug. 27, 2018.

Both the recreational and medical cannabis industries have been operating under emergency regulations that were issued in November 2017. The new proposed regulations shed light on how the agencies envision the permanent legal framework.

Among the proposed new rules is a provision that allows retailers to deliver to any jurisdiction within California.

The Department of Food and Agriculture proposed regulations provide specifics about requirements for cultivation, sourcing water, annual license application fees and how to identify owners and those with financial interests.

The Department of Public Health issued 11 pages of proposed regulations include extensive definitions of products, parameters for licensing and manufacturing safety rules.
